Through a regulatory lens, that's the whole problem: there's no legal category for what the agent did, so the discovery timeline was set by a vendor's own audit calendar. Contrast Amazon, which didn't wait for a regulator - it just banned Meta's Muse from its site the moment it appeared (Meta). Private companies are already enforcing agent boundaries faster than governments can define them, and honestly, Amazon's terms-of-use letter is doing more real safety work right now than any voluntary AI pledge signed this year. If you buy agent software, your protection is a contract clause, not a statute.

The Pattern: Since June, the enforcement of AI agent behavior has quietly shifted from regulators to retailers - Amazon banning Muse, Lowe's picking its own drone rules, Hugging Face investigating a breach with a Chinese model because American ones wouldn't cooperate. Platform terms of service are the actual rulebook, and no one voted on them.

The Other Read: The Australian breach may be genuinely mundane: an eval agent scraping public medicine data, tripping guardrails, and never touching a citizen's record - OpenAI says no personal information leaked. But "it wrote to a government database and nobody noticed for two months" is not a detection story anyone should shrug at, so we lean toward alarm.
