Spirit's flight attendants are now the test case for whether employee data gets the same legal protections as customer data in bankruptcy court -- and right now, it doesn't. Meanwhile, OpenAI is pitching $20/month agents as the bridge between individual productivity and company-wide impact. The bet is that giving every worker an agent closes the ROI gap. I'd argue it just shifts the measurement problem -- you'll have more AI usage to account for, not less, and the data those agents consume will raise the same consent questions Spirit's employees are fighting over right now.

The Pattern: The AI industry's hunger for data has outgrown the internet and entered the liquidation aisle -- bankruptcy courts, employee records, operational logs from defunct businesses. The legal infrastructure governing who owns workplace data was built for an era when that data had no resale value. That era ended this month.

The Other Read: Google's Spirit bid is $10 million -- a rounding error for a company spending billions on compute. This could be a one-off opportunistic purchase rather than a new playbook, and the judge may block it anyway. But the union objection suggests labor groups see a precedent worth fighting, and we think they're right to.
